Patiala House Court Allows Custody Parole for Baramulla MP Engineer Rashid to Attend Parliament

The Patiala House Court on Saturday granted custody parole to jailed Baramulla MP Engineer Abdul Rashid Sheikh. This will allow him to attend the upcoming Budget Session of Parliament.

The order was passed by Prashant Sharma, an Additional Sessions Judge. The court allowed Rashid, who is currently lodged in Tihar Jail, to take part in the Budget Session of the Lok Sabha starting January 28. He will remain under custody during his visits. Click Here To Follow Our WhatsApp Channel

Engineer Rashid is an undertrial in a terror funding case. The court also clarified that the issue of who will pay the travel and security expenses during his custody parole will depend on the final decision of the Delhi High Court, where his appeal is still pending.

In November 2025, the Delhi High Court delivered a split verdict on Rashid’s plea. He had requested a change in the condition that required him to pay nearly ₹4 lakh towards travel and police deployment costs for attending Parliament.

Justice Vivek Chaudhary rejected the plea, while Justice Anup Jairam Bhambhani allowed it. Due to this difference, the matter was referred to Chief Justice D. K. Upadhyaya for further administrative directions.

Rashid’s lawyer argued that forcing an elected MP to pay daily custodial travel costs, including police salaries, limits his right to represent his voters. He said that while Rashid is ready to pay reasonable expenses, adding police salaries goes beyond the Delhi Prison Rules.

However, the Delhi Police defended the charges. They said the amount covers security arrangements, logistics, and deployment needed to escort an undertrial MP safely to Parliament.

Engineer Rashid is the chief of the Awami Ittehad Party. He contested the 2024 Lok Sabha election from jail and won by a huge margin. He defeated Omar Abdullah, Vice-President of the National Conference, by more than two lakh votes.

Rashid is the sitting MP from Jammu and Kashmir’s Baramulla constituency. He continues to remain in judicial custody while facing allegations in a terror funding case.

A Delhi court on Saturday allowed jailed Member of Parliament Engineer Rashid to travel to the Parliament to cast his vote in the upcoming Vice Presidential election on September 9.

In a statement, issued to news agency—Kashmir News Observer (KNO), AIP Chief spokesperson Inam Un Nabi said the Patiala House Court has directed that Er Rashid be taken in custody to Parliament for the limited purpose of casting his vote in the Vice Presidential elections.

“The court further directed that while Er Rashid will not be required to make any immediate payment for travel expenses, he must furnish an undertaking that he shall bear the cost of travel subject to the outcome of the pending appeals reserved for orders by the High Court,” reads the statement.

It reads that the court emphasised that all necessary arrangements will be ensured in line with Parliamentary rules and under due escort, while safeguarding his rights as a Member of Parliament.

Meanwhile, the AIP expressed gratitude to the legal team, especially Advocate Vikhyat Oberoi, who appeared on behalf of Er Rashid, for their persistent efforts and reiterated its demand for justice and fair treatment to the jailed MP—(KNO)

The Awami Ittehaad Party (AIP) has formally approached the Patiala House Court in New Delhi, seeking permission for its incarcerated president and Member of Parliament, Engineer Rashid, to participate in the upcoming Lok Sabha session scheduled to begin on July 21.

In a statement to Kashmir News Observer (KNO), AIP Chief Spokesperson Inam Un Nabi confirmed that the application was submitted today by Advocate Vikhyat Oberoi, who is representing Engineer Rashid in legal matters. The plea has been listed for hearing on July 15.

“Engineer Rashid is the elected representative of Baramulla. Preventing him from attending Parliament not only silences his voice but also robs his constituents of representation. Attending Parliament is not a favour—it’s his constitutional right and duty,” Inam Un Nabi said.

He added that the party remains hopeful that the judiciary will honour the principles of democracy and allow the MP to fulfill his responsibilities in the House.
