Nomination Papers of Sarjan Ahmad Wagay (Barkati) Rejected

Nomination Papers of Sarjan Ahmad Wagay Rejected Today ,he has filed nomination papers from the Zainpora Assembly constituency in Shopian district for the upcoming assembly polls in Jammu and Kashmir three day before.

Sarjan, popularly known as Sarjan Barkati, was the most prominent face during the protest rallies in South Kashmir districts of Shopian and Kulgam after the killing of Burhan Wani in 2016.
Killed in an encounter on July 8, 2016, Wani was the top district commander of Hizbul Mujahideen and became a poster boy of the militancy in Kashmir. His killing led to widespread protests in the valley, causing unrest in 2016, leading to the death of 90 people.

Barkati, was arrested on October, 2016 and was released in October 2020. He was arrested again in August 2023, in connection with a terror-funding case. Later, his wife was arrested too.
Barkati’s daughter, Sugra Barkati filed nomination papers on behalf of her father on Monday. She will campaign for her father, unless the nomination is rejected. Zainapora votes in first phase of polling on September 18.
The State Investigation Agency (SIA) that arrested Barkati in August 2023, said the case was about his involvement in orchestrating an extensive fund-raising campaign through crowd-funding, resulting in the generation of funds amounting to crores. “These funds were subsequently misused, involving money laundering and acquisition of undisclosed assets for propagation of radicalism within the Kashmir Valley,” the agency said, according to a report in Indian Express.

Delhi Court orders Release Kashmiri Separatist Leader Shabir Ahmad Shah

Shabir Shah

A Delhi court has ordered the release of Kashmiri separatist leader Shabir Ahmad Shah in a money laundering case linked to terror funding.

The order was issued by Additional Sessions Judge Dheeraj Mor of Patiala House Courts after observing that Shah has already served the maximum sentence of seven years under Section 3 of the Prevention of Money Laundering Act (PMLA).

The court noted that Shah had been in continuous custody since July 26, 2017, amounting to over seven years of imprisonment.

“Accordingly, in view of proviso to Section 436A CrPC, he is entitled to be released in this case. Therefore, he is directed to be released from judicial custody in this case. Release warrants be issued. He be released forthwith, if not required in any other case,” the court stated. The case will next be heard on October 23 for arguments on the charges.

In June, the court had granted statutory bail to Shah, acknowledging that he had already served more than half of the maximum sentence for the money laundering offense.  “Even if he is granted bail in this case, he is not likely to be released from the jail in the other said offences before 24.07.2024 i.e. the date on which the maximum punishment of 07 years in the present case expires for him as an under-trial prisoner,” the court had noted.

Jailed Barkati Participating In Assembly Elections

In a move reminiscent of jailed politician Er Rashid, whose son Abrar Rashid ran his Lok Sabha campaign from prison, Sarjan Barkati, popularly known as “Azadi Chahcha,” is preparing to run in the upcoming assembly elections from behind bars.

Barkati’s nomination has been submitted by his daughter, who is anticipated to lead the campaign on her father’s behalf. Barkati rose to prominence for his influential role in organizing major rallies and gatherings during the 2016 unrest in Kashmir, where his powerful speeches and slogans resonated widely.

On August 28 of the previous year, Barkati was detained on charges of raising and allegedly misusing funds for radical activities in Kashmir. (KNS)
