Omar Abdullah is Just Creating Unnecessary Controversy Over Restoration of statehood: Tarun Chugh

Bharatiya Janata National party (BJP) General Secretary Tarun Chugh has criticized Jamu and Kashimir CM Omar Abdullah for attempting to politicise and create controversy over restoring statehood to the region.

Speaking to ANI, Chugh said “Prime Minister Narendra Modi and Union Home Minister Amit Shah have committed to restore statehood and he will fulfill his promise but the Jammu Kashmir CM Omar Abdullah has been doing politics continuously and has been creating unnecessary controversy.”

On October 19, the Jammu and Kashmir Cabinet passed a resolution urging the Union Government to restore statehood of the Union Territory.

The Cabinet which met under the chairmanship of Chief Minister Omar Abdullah, on Thursday passed a unanimous resolution for restoration of statehood in its original form.

The Cabinet has authorised CM Abdullah to take up the matter with the Prime Minister Narendra Modi and Government of India for restoration of statehood.

An official spokesperson said that the Chief Minister would be proceeding to New Delhi in coming days to meet the Prime Minister and Union Ministers in this regard.

In response to it, People’s Democratic Party (PDP) leader Waheed Parra posted on X and said, “Omar Abdullah’s first resolution on statehood is nothing less than ratification of the August 5th, 2019 decision. No resolution on Article 370 and scaling down the demand to mere statehood is a huge setback, especially after seeking votes on the promise of restoring Article 370.”

The Cabinet also decided summoning of the Legislative Assembly at Srinagar on November 4 and advised Lieutenant Governor to summon and address the Legislative Assembly.

The Council also made recommendation to the LG for appointment of Mubarik Gul as Protem Speaker who will administer oath to the elected members of the Legislative Assembly on October 21.

The NC-Congress alliance won the assembly polls in J-K held after a gap of ten years. JKNC won 42 seats while the Congress managed to win six. (ANI)

Supreme Court of India Agrees to list plea for Restoration of Statehood in of Jammu and Kashmir within 2 Months

The Supreme Court (SC) on Thursday agreed to list for hearing an application seeking direction for restoration of the statehood of Jammu and Kashmir within two months.Advocate Gopal Shankarnarayan mentioned the application for urgent listing of the matter, to which a bench headed by Chief Justice of India DY Chandrachud said that it will list the case.

The application has said that it becomes necessary that appropriate directions are passed directing the status of Statehood of Jammu and Kashmir to be restored at the earliest in a time-bound manner as had been undertaken by the Union of India.

Filed by college teacher Zahoor Ahmed Bhat and activist Khurshaid Ahmad Malik, the application stated that despite the assurance given by the Solicitor General that Jammu and Kashmir’s statehood would be restored, the Union has not taken any steps in that regard in the last ten months after the judgment in the Article 370 case.

The application was filed through advocate Soyaib Qureshi in the disposed of case of abrogation of Article 370 which the Supreme Court upheld the abrogation of the special status of Jammu and Kashmir.

“The applicants, being the conscious citizens of Jammu and Kashmir are aggrieved that, even after the passing of 10 months of the order dated August 11, 2023, till date no steps have been taken to restore the status of statehood of Jammu and Kashmir as a state which is gravely affecting the rights of the inhabitants of Jammu and Kashmir and also violating the basic structure of federalism; and it is for that reason that the applicants have preferred the present application to seek appropriate directions to the Union of India for restoration of the statehood of Jammu and Kashmir in a time-bound manner within a period of two months,” stated the application.

If directions to restore the status of the Statehood of Jammu and Kashmir are not passed at the earliest by this court it would lead to grave harm being caused to the federal structure of the country, it added.

Referring to the recently concluded polls in Jammu and Kashmir, the application stated that the formation of the Legislative Assembly before the restoration of statehood would violate the idea of federalism, which forms part of the basic structure of the Constitution of India.

Since the recently concluded assembly elections were conducted peacefully, there would be no security concerns in case the apex court passed a direction to restore statehood to the Union Territory within a time-bound period, it submitted.

“The delay in restoration of Statehood would cause serious reduction of democratically elected government in Jammu and Kashmir causing grave violation of the idea of federalism which forms part of the basic structure of the Constitution of India,” the application further added.

It was also contended that the conversion of the State of Jammu and Kashmir into two Union Territories has resulted in Jammu and Kashmir being given a lesser form of elected democratic government, which will soon be formed once the results of the Legislative Assembly are declared.

It added, “If the status of statehood is not restored to Jammu and Kashmir in a time bound manner, grave prejudice would be caused to the citizens of Jammu and Kashmir also leading to the violation of their fundamental rights and also gravely affecting the democratic structure of Jammu and Kashmir and its territorial integrity.”

For Jammu and Kashmir, which has always had a federal relationship with the Union of India, it is of utmost importance that the status of statehood is restored “so that they can enjoy autonomy in their individual identity and also play an important part in the overall development of the Country”, the application added.
