ED Files Charges Against Former PHED Chief Engineer and Four Others in ₹3.54 Crore Misappropriation Case

According to a statement issued here, The ED Srinagar Zonal Office, has filed a Prosecution Complaint before the Hon’ble Special Court (PMLA), Srinagar, against Ghulam Mohammad Bhat, then Chief Engineer, Public Health Engineering Department (PHED), Kashmir, along with four others — Rajinish Pal, Mohammad Amin Wani, Nisar Ahmad Bhat, and Imran Baba, Partner in M/s Baba Enterprises — under the provisions of the Prevention of Money Laundering Act (PMLA), 2002.

The complaint follows an investigation initiated on the basis of an FIR registered by the Anti-Corruption Bureau (ACB), Srinagar, against the accused officials for misappropriation of Government funds.

ED’s probe revealed that the accused officials, in criminal conspiracy with M/s Baba Enterprises, misappropriated Government funds during procurement of spare parts for water filtration plants, causing wrongful loss to the public exchequer.

The investigation established that tenders were awarded to M/s Baba Enterprises without following due procedure, and separate tenders were not floated for additional procurement worth ₹2.30 crore. Security deposits and earnest money deposits were also not collected as per norms, and the total deposits were taken as ₹7 lakh only instead of ₹1.43 lakh each.

It was further revealed that M/s Baba Enterprises received ₹3.54 crore from PHED but paid only ₹1.55 crore to the original supplier, M/s Industrial Devices (India) Pvt. Ltd., New Delhi, while diverting the remaining ₹1.56 crore for the purchase of immovable properties in Srinagar — including 18 marla land in Barinambal and 27.5 marla land in Hyderpora.

ED has attached immovable properties worth ₹1.56 crore, and further investigation is in progress.
