Delhi Court Seeks NIA Reply on Engineer Rashid’s Plea to Attend Budget Session in Custody

A Delhi court on Friday sought a response from the National Investigation Agency (NIA) on a plea filed by jailed Lok Sabha MP Engineer Rashid, seeking permission to attend the upcoming Budget Session of Parliament while remaining in custody.

Rashid’s counsel, Vikhyat Oberoi, submitted the plea requesting custody parole for his client to attend parliamentary proceedings.

Earlier, in November last year, the court had allowed Rashid to attend Parliament’s Winter Session in custody on all sitting days. The court had also granted him custody parole from July 24 to August 4, 2025, to attend the Monsoon Session of Parliament.

In 2024, the court had permitted Rashid interim bail to campaign for the Jammu and Kashmir Assembly elections.

The independent MP has been lodged in Tihar Jail since 2019, following his arrest by the NIA under the Unlawful Activities (Prevention) Act in connection with a 2017 terror-funding case.

In the 2024 Lok Sabha elections, Rashid won the Baramulla seat by defeating National Conference leader Omar Abdullah by a margin of over two lakh votes.

 Awami Itihaad Party (AIP) Chief Spokesperson Inam Un Nabi today shared with the media a letter MP Baramulla Er Rashid has sent to Prime Minister Narendra Modi regarding the growing disconnect between the Lieutenant Governor and the Chief Minister in Jammu and Kashmir.

“I write to you with deep concern about the growing administrative disconnect between the Lieutenant Governor’s administration and the office of the Chief Minister in Jammu and Kashmir, which has unfortunately begun to affect day-to-day governance and the delivery of essential public services,” wrote Rashid, in his letter to the PM.Click Here To Follow Our WhatsApp Channel

Er Rashid has warned that the situation “has started to create uncertainty among citizens and has slowed down decision-making on key developmental and welfare matters.”

Referring to the impact on people, Er Rashid wrote: “People across Jammu and Kashmir are already dealing with difficult socio-economic conditions. Several developmental works, public grievances and routine administrative decisions are reportedly delayed because of friction or unclear lines of authority. This is causing distress to ordinary people who look towards the government with hope and expectation.”

Urging the Prime Minister to intervene, the MP Er Rashid stated: “Only your intervention can ensure smooth governance, restore clarity of functioning and uphold the credibility of both institutions for the larger good of the Jammu and Kashmir.”

He concluded with an appeal for coordinated governance: “I respectfully request your goodself to kindly look into the matter and take steps you deem appropriate to ensure coordinated functioning between the Lieutenant Governor and the Chief Minister so that governance remains stable, responsive and people-centric.”

According to sources cited by The Indian Express, Rashid’s transfer from Jail Number 3 to Jail Number 1 was carried out as a precautionary measure after his security was reviewed following the alleged attack.

Sources said it is the same cell where former Deputy Chief Minister of Delhi and Aam Aadmi Party (AAP) leader Manish Sisodia was lodged in connection with the Delhi Excise Policy scam in 2023.

“Regular checks are being conducted with the help of CCTV cameras installed around his ward. Warders have been instructed to keep a close watch outside the confinement area,” a source said.

Rashid, 58, has been shifted to Tihar’s oldest Jail Number 1, where he is lodged alone in a separate cell of Ward Number 9, according to a highly placed source in the Delhi government. As per the jail manual, an inmate can stay alone or with up to two other inmates in a cell, an official added.

Sources said the MP, who has been lodged in Tihar Jail since 2019, was attacked by some inmates and sustained a minor injury during an altercation that reportedly took place at the end of August. Rashid later disclosed his “narrow escape” during a legal meeting with his lawyer, Javeed Hubbi, in September.

Awami Itihaad Party (AIP) has expressed deep concern and outrage over revelations made by incarcerated Member of Parliament from Baramulla Engineer Rashid during his recent legal meeting with his counsel Adv. Javeed Hubbi.

Adv. Hubbi said that Er Rashid disclosed how “Tihar Jail authorities have devised new methods to harass Kashmiri prisoners by deliberately lodging male eunuchs with them inside barracks, who are encouraged to provoke, attack and create a hostile environment.”He further revealed that Er Rashid had a narrow escape when a group of these male eunuch inmates together pushed and threw a gate on him. “It was a miraculous escape. Had it hit directly, it could have been fatal. This is nothing short of a deliberate attempt to physically harm him,” Hubbi stated. According to Er Rashid’s account, Kashmiri inmates including Ayoub Pathan of Beerwah, Bilal Mir of Qamarwari and Amir Gojri of Srinagar were first attacked by these male eunuchs, while Arshid Tanch of Kupwara was also subjected to humiliation. Despite facing this behaviour patiently, the harassment crosses all limits whenever Kashmiris begin their nimaz, with deliberate attempts made to disturb and provoke them.

Shockingly, Er Rashid revealed that these male eunuchs have been declared HIV positive and are intentionally placed with Kashmiri detainees. He also cautioned that notorious gangsters inside Tihar Jail appear to be backing this sinister campaign, targeting Kashmiris systematically for the last three months.

AIP, while expressing deep concern and anguish, has demanded an independent probe, strict accountability of the jail authorities and immediate guarantees for the safety and dignity of Er Rashid and all Kashmiri detainees. [KNT]

A Delhi court adjourned to July 22 its order on Lok Sabha MP Engineer Rashid’s plea to attend the monsoon session of Parliament which began today.

Additional sessions judge Chander Jit Singh on Monday adjourned the plea of the Baramulla MP, who sought either interim bail or custody parole, to carry out his duty as a parliamentarian.

The court had reserved its verdict on the plea on July 15.Custody parole entails a prisoner being escorted by armed police personnel to the plea.

Rashid’s counsel Vikhyat Oberoi had submitted his client should be allowed to attend the parliamentary session by granting interim bail.In the alternative, Rashid could be allowed custody parole, without payment of travel costs, he added.

The National Investigation Agency (NIA) opposed the plea, saying interim bail should not be granted and custody parole could be allowed only after payment of travel expenses.

Rashid has been lodged in Tihar jail since 2019 after he was arrested by the NIA under the Unlawful Activities (Prevention) Act in a 2017 terror funding case.

The Baramulla MP, who defeated Omar Abdullah in the 2024 Lok Sabha polls, is facing trial in the case for allegedly funding separatists and terror groups in Jammu and Kashmir.

According to the NIA’s FIR, Rashid’s name cropped up during the interrogation of businessman and co-accused Zahoor Watali.

After being chargesheeted in October 2019, a special NIA court framed charges against Rashid and others in March 2022 under Sections 120B (criminal conspiracy), 121 (waging war against the government), and 124A (sedition) of IPC and for offences relating to terrorist acts and terror funding under UAPA.

Delhi High Court Reserves Order on Engineer Rashid’s Plea to Attend Parliament in Custody

The Delhi High Court on Tuesday reserved an order on the Baramulla MP Engineer Rashid’s plea seeking permission to attend the ongoing Parliament session in custody. He sought permission to attend the parliament session in custody.

A division bench of justices Chandra Dhari Singh and Anup Jairam Bhambhani reserved the order after hearing the submissions of counsel for Engineer Rashid and the National Investigation Agency (NIA).

The bench said, ” We will pass an order.”

Senior advocate N Hariharan and advocate Vikhyat Oberoi appeared for Abdul Rashid Sheikh (also known as Engineer Rashid) and argued that I am asking for permission to attend Parliament Session.

“Earlier I (Engineer Rashid) was granted custody parole by the single judge bench,” the counsel argued.

The NIA opposed the plea and submitted that there were serious charges against the petitioner.

Senior advocates argued that serious conditions can be imposed. NIA said that once you enter the parliament court conditions would not apply. What happenes If he makes a speech there, NIA asked.

The counsel for the petitioner submitted that the petitioner was allowed to campaign for the elections despite facing charges at the time also. It was further submitted that Engineer Rashid was allowed to take oath in parliament.

“My (Engineer Rashid) allegiance to this country is beyond any doubt. I was granted interim bail for the campaign, not opposed,” the counsel argued.
While opposing the plea, NIA said that there was a Violation of the jail rule, he was found with the mobile phone. He can borrow anyone’s phone and can contact anybody from Parliament. He is not in the custody once he enters the parliament.

“No fundamental right to attend the parliament. The plea should be rejected on merit,” ASG Rajkumar Bhaskar Thakare submitted.
At this point, Justice Bhambhani said, “He (Petitioner) was allowed to attend the parliament. People in custody are allowed to attend weddings, and perform the cremation ceremony.”

NIA submitted that those reliefs are on humanitarian grounds. What if the accused faces anti-national charges, and makes a statement, once damage is done, it is done.

Senior advocate argued that,”I (Engineer Rashid) am not asking for bail, send me in custody. I’m not asking for interim bail.”

Justice Chandra Dhari Singh said, ” Once he enters parliament, the custody is gone.”

“My custody can be ensured through the speaker,” the senior counsel argued .”Do we have the power to direct the speaker,” the bench asked.

“Yes, my lord, you did this,” senior advocate submitted.

On the other hand, NIA submitted that there are allegations against Rashid of collecting funds for terrorist activities in India. He has no right to attend the parliament.

Justice Bhambhani said, ” You are asking us to ignore the fact that he is an elected representative. There is a provision for going out of jail in custody. What is the conflict, where is it?”

“Please don’t undermine the power of speaker and Lok sabha secretariat to control,” Justice Bhambhani said.

At this point, Justice Chandra Dhari Singh said to counsel for the petitioner, ” 43 D coming in your way, therefore you are not pressing for interim bail or custody parole.”

The ASG submitted that Special permission from the secretary general of Lok Sabha secretariat will be required to allow one personnel with him.

Engineer Rashid’s plea for custody parole to attend the parliament was rejected by the special NIA court on March 10.

Delhi Court Rejects Bail Decision for Engineer Rashid in Jammu and Kashmir Terror Funding Case

Delhi’s Patiala House Court on Tuesday rejected an application seeking a decision on the regular bail plea of Engineer Rashid, Member of Parliament, in connection with the Jammu and Kashmir terror funding case.

The court clarified that, at this stage, it is only empowered to address miscellaneous applications and not to rule on the regular bail petition.

Recently, the district judge returned the case to the ASJ court after a request from the ASJ for the matter to be transferred to a designated court for lawmakers, given Engineer Rashid’s status as an MP.

This transfer request was made with the consent of both the accused and the prosecuting agency, the National Investigation Agency (NIA). The district judge’s decision came after noting that the issue of court jurisdiction was still pending before the Delhi High Court. Until the High Court rules on jurisdiction, the ASJ court will continue to hear the case.

Both Rashid’s counsel and the NIA had agreed to keep the matter in the current court. In addition to the NIA’s case, the special judge had suggested moving a related money laundering case and Rashid’s regular bail application to the court designated for lawmakers.

Engineer Rashid, an Independent Lok Sabha MP from Baramulla, Jammu and Kashmir, has recently surrendered at Tihar Jail after his interim bail expired. This is related to the Jammu and Kashmir terror funding case currently being investigated by the NIA.

In August 2019, Rashid was arrested under the Unlawful Activities (Prevention) Act (UAPA). During his incarceration, he filed his nomination for the 2024 parliamentary elections from jail and won by a margin of 204,000 votes, defeating former Jammu and Kashmir Chief Minister Omar Abdullah.

In 2022, the NIA Court of Patiala House Court ordered the framing of charges against Rashid and several other key figures, including Hafiz Saeed, Syed Salahuddin, Yasin Malik, Shabbir Shah, Masrat Alam, Zahoor Ahmed Watali, Bitta Karate, Aftab Ahmed Shah, Avtar Ahmed Shah, Naeem Khan, and Bashir Ahmed Butt (also known as Peer Saifullah).

The charges are part of an ongoing investigation into terror funding in Jammu and Kashmir, where the National Investigation Agency (NIA) alleges that various militant organizations, such as Lashkar-e-Taiba, Hizbul Mujahideen, Jaish-e-Mohammed, and JKLF, collaborated with Pakistan’s intelligence agency, ISI, to orchestrate attacks on civilians and security forces in the region.

The NIA’s investigation claims that in 1993, the All Party Hurriyat Conference (APHC) was formed to further separatist activities, with funding channelled through hawala and other covert methods. Hafiz Saeed, along with Hurriyat leaders, is accused of using these illicit funds to fuel unrest in Jammu and Kashmir, targeting security forces, inciting violence, burning schools, and damaging public property. The agency contends that these operations were designed to destabilise the region and promote terrorism under the guise of political resistance. (ANI)

Not Ready To Join Hands With BJP,Awami Ittehad Party (AIP) Aim is to Bring Permanent Peace in Kashmir: Engineer Rashid

Awami Ittehad Party (AIP) President Sheikh Abdul Rashid alias Engineer Rashid on Tuesday dismissed speculation about aligning with the BJP and asserted that the main aim of his party is to restore peace in Kashmir.

“Why will I join hands with the BJP? Power is a very small thing for me. I was an independent MLA and I would have joined any party. If power had been my priority I would have joined hands with PM Modi.

Many people have died in Kashmir. My biggest concern is to make sure that these killings should stop,” Sheikh Abdul Rashid said.

“Priority is how the leadership will work after getting the mandate of the public. Will they, like the traditional parties PDP, JKNC, INC, and BJP after winning elections roam like VVIPs…Kashmir has to go beyond that…Awami Ittehad Party (AIP) will aim to bring permanent peace to Kashmir,” he added.

Engineer Rashid said that the recent increase in voter turnout in Kashmir, attributing it to the state’s repression.

He emphasized that the people of Kashmir are eager for change and wish to express their feelings through democratic means.

“The voting percentage has increased because people have been victims of state repression…the voice of the people has been suppressed since the PDP came to power in 2014. People want to express their feelings and they want change because they have understood that they can achieve something only through democratic means. Violence has no place in society…the people of Kashmir have always believed in democracy. They also wanted a democratic solution to the Kashmir issue. I hope an era of reconciliation will begin after the voting,” Rashid said.

Abdul Rashid Sheikh, commonly referred to as Engineer Rashid, is a former two-time Member of the Legislative Assembly (MLA) representing the Langate constituency in northern Kashmir.

Rashid, who had been arrested and faced charges under the Unlawful Activities (Prevention) Act (UAPA), was granted interim bail from Tihar Jail in September. The special NIA court in Delhi approved the bail to enable Rashid to campaign for the Jammu and Kashmir assembly elections. He is required to surrender on October 3.

Rashid gained significant recognition when he defeated two prominent candidates in Jammu and Kashmir during the 2024 Lok Sabha elections, Omar Abdullah from the National Conference and Sajad Lone from the Baramulla seat.

This victory took place while he was in jail, with his son, Abrar Rashid, leading the campaign on his behalf.

Rashid’s party, the Awami Ittehad party has fielded 34 candidates in the 2024 Assembly elections. His younger brother, Khurshid Ahmad Sheikh, is a candidate for the Langate seat in north Kashmir’s Kupwara district.

The polling for the third and final phase of the Jammu and Kashmir assembly elections began at 7am today with people queueing up at a polling station across 40 constituencies in seven districts of the Union Territory.

At least 415 candidates, including former deputy Chief Ministers Tara Chand of Congress and Muzaffar Hussain Beig, are contesting in the third phase. Mock polling also took place at various polling booths before the start of the polls.

The first phase of voting took place on September 18, and the second phase concluded on September 25. The counting of the votes will be done on October 8. (ANI)

In a spirited display of support, followers of detained former lawmaker Engineer Sheikh Abdul Rashid organized a vibrant road show stretching from Baramulla to Uri as part of their electoral campaign for the Lok Sabha elections.

Leading the charge was Engineer Rashid’s 26-year-old son, Abrar Rashid, spearheading the rally covering a 50-kilometer route. Addressing enthusiastic crowds along the way, Abrar emphasized the grassroots nature of their movement, reliant not on flashy banners or vehicles, but on the steadfast support of the people. “Today’s vote is not just for my father, but for his unwavering spirit and the injustices he fights against,” he declared.

Engineer Rashid, a vocal advocate from Langate, has spent five years behind bars in Tihar jail, known for championing the rights of the common people and vehemently opposing alleged human rights abuses. A formidable figure in North Kashmir politics, he is contesting the Lok Sabha elections from Baramulla as an independent candidate.

Former legislator Shoiab Lone, representing the Democratic Progressive Azad Party (DPAP), stood alongside Engineer Rashid’s supporters during the roadshow, rallying for his cause both on the streets and on social media platforms. Confident in the loyalty of voters from Baramulla, Kupwara, Bandipora, and Budgam, Lone expressed optimism in their steadfast support.

Despite facing formidable challenges, including his arrest by the NIA in 2019 on charges related to terror funding, Engineer Rashid remains undeterred, symbolized by his campaign emblem—a pressure cooker. His entry into the electoral fray adds a dynamic element to the contest, potentially reshaping the political landscape in the region and posing a significant challenge to established parties like the NC and others.
