Sarjan, popularly known as Sarjan Barkati, was the most prominent face during the protest rallies in South Kashmir districts of Shopian and Kulgam after the killing of Burhan Wani in 2016.
Killed in an encounter on July 8, 2016, Wani was the top district commander of Hizbul Mujahideen and became a poster boy of the militancy in Kashmir. His killing led to widespread protests in the valley, causing unrest in 2016, leading to the death of 90 people.

Barkati, was arrested on October, 2016 and was released in October 2020. He was arrested again in August 2023, in connection with a terror-funding case. Later, his wife was arrested too.

The order was issued by Additional Sessions Judge Dheeraj Mor of Patiala House Courts after observing that Shah has already served the maximum sentence of seven years under Section 3 of the Prevention of Money Laundering Act (PMLA).

The court noted that Shah had been in continuous custody since July 26, 2017, amounting to over seven years of imprisonment.

In June, the court had granted statutory bail to Shah, acknowledging that he had already served more than half of the maximum sentence for the money laundering offense.  “Even if he is granted bail in this case, he is not likely to be released from the jail in the other said offences before 24.07.2024 i.e. the date on which the maximum punishment of 07 years in the present case expires for him as an under-trial prisoner,” the court had noted.

Jailed Barkati Participating In Assembly Elections

Barkati’s nomination has been submitted by his daughter, who is anticipated to lead the campaign on her father’s behalf. Barkati rose to prominence for his influential role in organizing major rallies and gatherings during the 2016 unrest in Kashmir, where his powerful speeches and slogans resonated widely.

On August 28 of the previous year, Barkati was detained on charges of raising and allegedly misusing funds for radical activities in Kashmir. (KNS)
