Government of J&K Should Pass Resolution Condemning the August 5, 2019 Decision: Sajad Lone

sajad lone

People’s Conference, Sajad Lone stated on Wednesday that the new government of Jammu and Kashmir should pass a resolution condemning the August 5, 2019 decision and the restrictions imposed on political leaders that day.

He acknowledged the presence of an elected government and urged political differences to be set aside, congratulating the National Conference and Omar Abdullah on his election as chief minister.

He insisted that the actions taken on August 5, 2019, were illegal and that they reject those actions, calling for the central government to return what it has taken.

Lone expressed support for the government, noting that history would be made with the first debate on Article 370 in the Assembly. He questioned why Jammu and Kashmir is the only region designated as a union territory and urged leaders to unite for the restoration of statehood.

He warned that failing to protest the August 5 decision would imply acceptance of the permanent loss of rights established in 2019.

Reflecting on the election campaigns, he remarked that claims regarding the restoration of Article 370 ceased once the elections ended, highlighting that the issue appeared to have been used solely for political gain.

He added that people have placed their hopes in the National Conference manifesto, expressing optimism that they can deliver, and noted that being in a union territory presents challenges for everyone.

Supreme Court upholds bail for Kashmiri journalist Fahad Shah, critiques High Court’s UAPA ruling

Supreme Court

While choosing not to revoke Fahad Shah’s bail, the Supreme Court on Tuesday declared the Jammu and Kashmir and Ladakh High Court’s ruling on bail under the Unlawful Activities (Prevention) Act (UAPA) as legally flawed.

The High Court had previously granted bail to journalist Peerzada Shah Fahad, asserting that a defendant could be granted bail if they posed no “clear and present danger” to society. It also ruled that diminishing India’s global reputation does not constitute a terrorist act under Section 15 of the UAPA.

The Supreme Court’s bench, led by Justices Bela Trivedi and Satish Chandra Sharma, labeled the High Court’s decision as per incuriam, meaning it should not be used as legal precedent, but chose not to revoke Fahad Shah’s bail, reported Live Law.

The High Court had cited the 1919 U.S. Supreme Court case Schenck v. United States to emphasize the necessity of proving a “clear and present danger” for UAPA arrests.

The US Supreme Court while addressing the limits of freedom of speech recognized that while the prohibition against abridging free speech is significant, it is not absolute and may be subject to circumstances.

The Court stated that for a speech to not be protected, the central issue is whether the words create a “clear and present danger” of causing substantive evils that Congress has the authority to prevent.
