Supreme Court of India Agrees to list plea for Restoration of Statehood in of Jammu and Kashmir within 2 Months

The Supreme Court (SC) on Thursday agreed to list for hearing an application seeking direction for restoration of the statehood of Jammu and Kashmir within two months.Advocate Gopal Shankarnarayan mentioned the application for urgent listing of the matter, to which a bench headed by Chief Justice of India DY Chandrachud said that it will list the case.

The application has said that it becomes necessary that appropriate directions are passed directing the status of Statehood of Jammu and Kashmir to be restored at the earliest in a time-bound manner as had been undertaken by the Union of India.

Filed by college teacher Zahoor Ahmed Bhat and activist Khurshaid Ahmad Malik, the application stated that despite the assurance given by the Solicitor General that Jammu and Kashmir’s statehood would be restored, the Union has not taken any steps in that regard in the last ten months after the judgment in the Article 370 case.

The application was filed through advocate Soyaib Qureshi in the disposed of case of abrogation of Article 370 which the Supreme Court upheld the abrogation of the special status of Jammu and Kashmir.

“The applicants, being the conscious citizens of Jammu and Kashmir are aggrieved that, even after the passing of 10 months of the order dated August 11, 2023, till date no steps have been taken to restore the status of statehood of Jammu and Kashmir as a state which is gravely affecting the rights of the inhabitants of Jammu and Kashmir and also violating the basic structure of federalism; and it is for that reason that the applicants have preferred the present application to seek appropriate directions to the Union of India for restoration of the statehood of Jammu and Kashmir in a time-bound manner within a period of two months,” stated the application.

If directions to restore the status of the Statehood of Jammu and Kashmir are not passed at the earliest by this court it would lead to grave harm being caused to the federal structure of the country, it added.

Referring to the recently concluded polls in Jammu and Kashmir, the application stated that the formation of the Legislative Assembly before the restoration of statehood would violate the idea of federalism, which forms part of the basic structure of the Constitution of India.

Since the recently concluded assembly elections were conducted peacefully, there would be no security concerns in case the apex court passed a direction to restore statehood to the Union Territory within a time-bound period, it submitted.

“The delay in restoration of Statehood would cause serious reduction of democratically elected government in Jammu and Kashmir causing grave violation of the idea of federalism which forms part of the basic structure of the Constitution of India,” the application further added.

It was also contended that the conversion of the State of Jammu and Kashmir into two Union Territories has resulted in Jammu and Kashmir being given a lesser form of elected democratic government, which will soon be formed once the results of the Legislative Assembly are declared.

It added, “If the status of statehood is not restored to Jammu and Kashmir in a time bound manner, grave prejudice would be caused to the citizens of Jammu and Kashmir also leading to the violation of their fundamental rights and also gravely affecting the democratic structure of Jammu and Kashmir and its territorial integrity.”

For Jammu and Kashmir, which has always had a federal relationship with the Union of India, it is of utmost importance that the status of statehood is restored “so that they can enjoy autonomy in their individual identity and also play an important part in the overall development of the Country”, the application added. Several CRPF troopers injured in Accident at Gorge near Khaygam crossing in Pakherpora Budgam

Several CRPF troopers were injured in a road accident in Pakherpora area of central Kashmir’s Budgam district on Thursday morning, officials said.

An official told that a CRPF vehicle fell down in a gorge near Khaygam crossing in Pakherpora today morning.

He said that several troopers were injured in the incident. “They have been evacuated to a nearby hospital for treatment,” he said—(KNO)

Chief Minister Omar Abdullah to Visit Fire-Ravaged Marwah in Kishtwar

Jammu and Kashmir Chief Minister Omar Abdullah has announced his visit to the remote Marwah area in Kishtwar district, where a massive fire on Monday destroyed over 70 houses, leaving numerous families homeless.

The Chief Minister, deeply concerned by the scale of the disaster, is expected to meet with the affected families and oversee the ongoing relief operations.The fire, which devastated the remote area, has prompted an urgent response from the government on the 2nd day after taking oath.

CM Abdullah’s visit aims to assess the situation firsthand and ensure that adequate relief is being provided, an official said.Speaking ahead of his visit, Abdullah expressed his commitment to aiding the victims.

“I am traveling to Marwah to meet the families whose lives have been turned upside down by this tragic fire,” he posted on social media according to KNS correspondent.

During his visit, Abdullah is expected to direct officials to expedite the rehabilitation process, ensuring food, shelter, and other necessities are promptly delivered. (KNS)

Close Wine Shops Across Kashmir Social Activist Javid Ahmad Urged the Government

Javid Ahmad urges the government to close the wine shops in Kashmir as the people of Jammu and Kashmir have always valued their rich cultural and spiritual heritage, which is deeply rooted in the principles of peace, unity, and moral values. However, the recent proliferation of wine shops in various parts of Kashmir has raised serious concerns among the local population.

Javid Ahmad said that keeping in view cultural and religious Sensitivity, Kashmir is a region where a majority of the population adheres to Islamic principles that strictly prohibit the consumption of alcohol. The existence of wine shops not only offends the religious sentiments of a large section of society but also undermines the cultural ethos of Kashmir. The availability of alcohol has led to an increase in social problems, including domestic violence, public disturbances, and a rise in criminal activities. Closing these shops would greatly contribute to restoring peace and harmony within our communities.

Javid Ahmad further said that the easy access to alcohol poses a significant risk to the youth of Kashmir. Alcohol abuse has been linked to numerous health issues, including addiction, mental health problems, and other chronic diseases. The closure of wine shops will safeguard the future of our younger generations and promote a healthier society. The majority of the people in Kashmir have expressed their opposition to the sale of alcohol. The closure of wine shops is in line with the public will and democratic values that prioritize the well-being of the community over commercial interests.

Javid Ahmad urges the government to take immediate steps to address this issue, keeping in mind the social, cultural, and moral fabric of Kashmir. The closure of wine shops will not only help preserve the sanctity of the region but will also promote a safer and more prosperous future for all citizens and hope for prompt and positive action on this pressing matter. Dalai Lama wrote to congratulate Omar Abdullah on his coalition’s success in the recent Assembly Polls and his appointment as the Chief Minister of Jammu Kashmir in the Assembly polls.

“As I have mentioned before, I have had the privilege of knowing three generations of your family from the days of Sheikh Abdullah to you. I treasure our friendship. I wish you every success in meeting whatever challenges may lie ahead and the opportunities arise to fulfil the hopes and aspirations of the people of Jammu & Kashmir,” he wrote.

On Wednesday, Abdullah took oath as the Jammu Kashmir CM and started his innings with a people-friendly gesture and conveyed that he has asked the police to not have a “green corridor” or traffic stoppage during his movement by road.

He also asked the police to make sure that minimum inconvenience was caused to the people.

The National Conference leader was administered the oath of office and secrecy by the LG Manoj Sinha at Sher-i-Kashmir International Conference Centre (SKICC) in Srinagar.

Surinder Kumar, MLA from Nowshera in Jammu, was sworn in as the Deputy Chief Minister of Jammu and Kashmir along with other ministers.

Congress President Mallikarjun Kharge, Leader of Opposition in Lok Sabha Rahul Gandhi, Congress general secretary Priyanka Gandhi Vadra and other leaders of the INDIA bloc were also present for the swearing-in ceremony.

After taking the oath, Omar Abdullah received a guard of honour at the Civil Secretariat in Srinagar and held his first maiden meeting with secretaries of various departments.

He also said that the use of stick or aggressive gestures during road movements is to be avoided. He said he has asked his cabinet colleagues to follow the same example.

Omar Abdullah, who is heading the National Conference-led government in the state, has the backing of other parties in the INDIA alliance and four independents. The NC-Congress alliance won a majority in the assembly polls.

Omar Abdullah had earlier served as Chief Minister of Jammu and Kashmir from 2009 and 2015. (ANI)

The Lt Governor interacted with the international players including Irfan Pathan, Martin Guptill, Hamilton Masakadza, Yusuf Pathan, Kedar Jadhav and Vinay Kumar and conveyed his felicitations to officials of Legends League Cricket and legendary Cricketers participating in the historic sporting spectacle.

In a social media post, the Lt Governor has termed the Legends League Cricket as the beginning of a new sporting era for Kashmir Valley. He said the historic event has marked the return of the International Cricket Tournament to the valley after 36 years.

Interacting with the media persons, the Lt Governor said the excitement and admiration the people of Kashmir valley have for legendary Cricketers is the reflection of peaceful, prosperous and Badalta Jammu Kashmir. This is also the result of our efforts to establish peace in the last 4-5 years, he said.

The Lt Governor highlighted the upgradation of Bakshi Stadium and MA Stadium and emergence of J&K as hub of International and National sporting events, under the guidance of Hon’ble Prime Minister Shri Narendra Modi.

The kind of crowd and enthusiasm among the people we have witnessed over the last one week, it seems like the cricket fever has gripped the entire Kashmir. A great beginning was made last year when Jammu had hosted the Legends League Cricket matches. We have the facilities to host any international level cricket matches in J&K, he said.

The Lt Governor also appreciated the efforts of the Sports department and Sports Council to promote sports culture and nurture young talent.

He said the J&K has immensely talented youth and the presence of Legendary Cricketers and events like Legends League Cricket will inspire many youths to bring laurels to the UT and the nation.

As National Conference Vice President Omar Abdullah took oath as the first Chief Minister of the Union Territory of Jammu and Kashmir on Wednesday, Sakina Itoo, the only woman minister in Omar Abdullah’s cabinet said that they would try to meet the expectations of the people and work for them.

Sakina Itoo said, “It is a very challenging job right now because people have a lot of expectations. But we will try to meet those expectations and work for the people as much as possible.”

She said that people voted in large numbers and took back their democratic rights.

She further said, “There are a lot of issues. The democratic rights of the people were snatched away in the last 10 years. The people took those rights back themselves by voting in such huge numbers. Their voice was suppressed, they were unheard, there was no development, there were so many difficulties in the power sector, health sector, price rise and unemployment have increased.”

Her father, Wali Mohammad Itoo, a senior NC leader and former speaker of the Jammu and Kashmir legislative assembly, was assassinated by militants.

On Wednesday, L-G Manoj Saxena administered the oath of office to Abdullah and his council of ministers at the Sher-i-Kashmir International Convention Centre (SKICC) in Srinagar.

J-K Lieutenant Governor Manoj Sinha administered the oath of office to Omar Abdullah along with his council of ministers.

National Conference MLA from Mendhar Javed Ahmed Rana, Javid Ahmad Dar from Rafiabad, Sakina Itoo from DH Pora and Surinder Kumar Chowdhary were also administered oath by LG Sinha as ministers in Cabinet.

Independent MLA from Chhamb assembly seat Satish Sharma was given a place in Omar Abdullah-led cabinet.

Congress President Mallikarjun Kharge, Lok Sabha Leader of Opposition Rahul Gandhi, and Congress general secretary Priyanka Gandhi Vadra were also present for the swearing-in ceremony.

Many INDIA Bloc leaders were present in the ceremony of the JKNC Vice President including Samajwadi Party Akhilesh Yadav, Communist Party of India (Marxist) leader Prakash Karat, NCP-SCP MP Supriya Sule, DMK MP Kanimozhi, AAP leader Sanjay Singh and CPI leader D Raja.

PDP leader Mehbooba Mufti was also present during the ceremony. This came after the Congress-National Conference secured 48 seats, with the NC winning 42 and the Congress only six seats in the Jammu Kashmir assembly elections. (ANI)

Jammu and Kashmir government on Wednesday appointed senior National Conference leader Nasir Aslam Wani as advisor to chief minister Omar Abdullah.

The decision was taken hours after Omar Abdullah took oath as the first chief minister of the Union territory of Jammu and Kashmir.

As per an order issued by Sanjeev Verma, Commissioner/ Secretary to the Government, said, “Nasir Aslam Wani is hereby appointed as advisor to the chief minister.The terms and conditions of the appointment shall be notified separately.”
