The development came after Ratna Singh, head of legal affairs for the CJP, challenged the legality of Dipke’s arrest and urged the Special Executive Magistrate (SEM) Court to order his immediate release.

In a post on X, Singh questioned why calling on citizens to participate in a peaceful national demonstration could be treated as an offence.

“The SEM Court should release Abhijeet Dipke, as his arrest is unlawful. He merely urged people to unfurl the Tiranga — how can that by itself be a crime?” Singh wrote.

CJP Questions Legality of Dipke’s Arrest

Singh also raised concerns about the circumstances surrounding Dipke’s detention, alleging that he was picked up outside his residence and that authorities did not promptly disclose his whereabouts.

She further claimed that his lawyers had been unable to meet him, raising questions about due process and fundamental rights.

Singh said preventive detention should not be used to justify unlawful action by the police. Her remarks came as Dipke was expected to appear before the SEM at Mandir Marg Police Station around noon on Saturday.

Police Detained Dipke Ahead of Tiranga Rally

Delhi Police detained Dipke on Friday to prevent him from leading the planned ‘Lehra Do Tiranga’ rally at Central Park in Connaught Place.

The authorities had imposed prohibitory restrictions under Section 163 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), restricting public gatherings in Central Delhi.

The detention took place amid demonstrations against the Election Commission over alleged irregularities in electoral roll revisions. Police said around 150 demonstrators had been detained and several FIRs registered over alleged violations of prohibitory orders.

Fresh Preventive Proceedings Against CJP Founder

Following the detention, police initiated fresh preventive proceedings against Dipke under Sections 126 and 170 of the BNSS.

The case is separate from an earlier action on October 10, when Dipke was required to sign a peace bond undertaking for one year.

The protests are part of wider demonstrations by Opposition leaders, INDIA bloc parties and student organisations against the Election Commission’s Special Intensive Revision (SIR) of electoral rolls and its handling of the electoral process.

Dipke’s release on bail marks a development in the case, while the controversy over the legality of his detention has raised further questions about the use of preventive measures during political demonstrations.
